1. Acceptance of Terms
By accessing and using mamaafricaglobal.com (the "Website") and engaging Mama Africa Global Logistics & Trading ("Company," "we," "us," "our") for any logistics, freight forwarding, or shipping services (the "Services"), you agree to be bound by these Terms of Service and all policies referenced herein. If you do not agree to these terms, you may not use the Website or request our Services.
These Terms constitute the entire agreement between you and Mama Africa Global regarding your use of the Website and Services. We reserve the right to modify these Terms at any time. Your continued use of the Website and Services after such modifications constitutes acceptance of the updated Terms.
2. Services Provided
Mama Africa Global Logistics provides freight forwarding, customs clearance, cargo consolidation, and door-to-door shipping services across the China–Europe–West Africa trade corridor, including:
- Sea Freight: Full Container Load (FCL) and Less than Container Load (LCL) services
- Air Freight: Express cargo shipment for time-critical deliveries
- Freight Forwarding: Complete import/export documentation and customs clearance
- Packaging & Crating: Professional wooden crating and secure packaging for fragile goods
- DDP (Delivery Duty Paid): Full door-to-door delivery with all taxes and duties included
- Real-Time Tracking: Live shipment visibility and status updates
Services are provided on a case-by-case basis and are subject to applicable laws, regulations, and carrier availability. We reserve the right to decline any shipment that does not meet our operational standards or violates local/international regulations.
3. Quotes & Pricing
Quote Validity: All quotes provided by Mama Africa Global are valid for 7 business days from the date of issue unless otherwise stated. Quotes are based on information provided by you and are subject to verification.
Price Changes: We reserve the right to adjust pricing if there are material changes to shipment specifications (weight, dimensions, origin, destination, special handling) or if carrier rates change. Any price adjustments will be communicated to you before shipment.
Additional Charges: The final invoice may include additional charges for customs fees, port fees, detention, storage, handling surcharges, fuel surcharges, or unforeseen circumstances. These will be itemized and explained to you before payment is due.
DDP vs. CIF: If you book DDP (Delivery Duty Paid) services, all taxes, duties, and customs clearance fees are included in the quoted price. For CIF (Cost, Insurance, and Freight) services, you are responsible for payment of duties and taxes upon delivery.
4. Payment Terms
Deposit & Full Payment: A 50% deposit is required to confirm and book your shipment. Full payment must be received before or upon collection/handover of goods. We accept bank transfers, mobile money, and other payment methods as agreed.
Late Payment: If payment is not received within the agreed timeframe, we reserve the right to:
- Hold your shipment at warehouse storage facilities (storage fees apply)
- Charge daily storage and handling fees
- Cancel your booking and forfeit your deposit
- Take legal action to recover outstanding amounts
Currency & Exchange: All prices are quoted in USD unless otherwise stated. Exchange rate fluctuations are your responsibility if payment is made in a different currency.
5. Liability & Limitations of Liability
Reasonable Care: Mama Africa Global will exercise reasonable care in the handling, storage, and transportation of your cargo. However, we cannot guarantee against loss, damage, theft, or delay caused by circumstances beyond our control, including but not limited to:
- Acts of God (natural disasters, extreme weather)
- War, terrorism, civil unrest, or strikes
- Government actions, customs delays, or border closures
- Carrier negligence or third-party logistics failures
- Port congestion or shipping line delays
- Mechanical or technical failures beyond our control
Liability Cap: Our total liability for any shipment is limited to the lesser of: (a) the actual value of the cargo as declared by you, or (b) the freight charges paid. We are not liable for consequential, indirect, incidental, or punitive damages, including loss of profits or business interruption.
Uninsured Shipments: If you decline insurance and your cargo is lost or damaged, we are not liable for full replacement value. Insurance coverage is strongly recommended.
6. Insurance & Damage Claims
Insurance Availability: We offer optional cargo insurance at an additional cost. If you choose to insure your shipment, you must declare the full value of the cargo. Insurance coverage is activated upon payment.
Damage Reporting: Any visible damage, loss, or discrepancy must be reported to us in writing within 48 hours of delivery. Include photos, delivery receipts, and a detailed description of damage. Claims reported after 48 hours may not be covered.
Claim Investigation: All damage and loss claims will be investigated by our team. Settlement is contingent on:
- Documentation of the shipment condition before handover
- Timely reporting of damage (within 48 hours)
- Cooperation with investigation and inspection
- Proof of insurance coverage (if applicable)
Resolution Timeline: Damage claims are typically resolved within 30 days of filing, subject to carrier response and investigation completion.
7. Intellectual Property Rights
All content on the Website, including text, graphics, logos, images, and software, is the property of Mama Africa Global or our content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit this content without our written permission.
Your use of the Website is limited to personal, non-commercial viewing. You may not scrape data, use bots, or engage in any automated access to the Website without explicit permission.
8. Dispute Resolution & Governing Law
Jurisdiction: These Terms and all disputes arising from your use of the Website and Services shall be governed by and construed in accordance with the laws of Italy (where our headquarters is located) and the jurisdiction of the courts in Valenza, Italy, without regard to conflict of law provisions.
Dispute Resolution: Before pursuing legal action, both parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes may be escalated to mediation or arbitration as mutually agreed.
Incoterms: All shipments are conducted under the most recent Incoterms standards (currently Incoterms 2020) unless otherwise specified in your booking agreement.
Regulatory Compliance: You guarantee that your cargo complies with all laws and regulations of the origin country, destination country, and any transit countries. You are responsible for obtaining all necessary permits, licenses, and certifications. Mama Africa Global is not liable for penalties, fines, or seizure due to non-compliance.
9. Data Privacy & Security
We collect and process personal information (name, email, phone, shipping address) to provide you with logistics services. This data is handled in accordance with GDPR and our Privacy Policy. We will never share your information with third parties without your consent, except as required by law or for carrier/customs purposes.
